LumoCade - Terms of Service

1. About LumoCade

LumoCade provides marketing tools for indie game developers. Developers use the Service to create countdown pages and send email campaigns to engage their players and fans.

The Service is available through a subscription model:

• Free – limited features and usage
• Pro ($19/month) – expanded limits
• Studio ($49/month) – full access with higher limits

Payments are processed through Paystack, and email delivery is handled via Resend.

2. Account Responsibilities

To use the Service, Developers must:

• Provide accurate registration information.
• Keep account credentials secure and confidential.
• Use the Service only for legitimate game marketing purposes.
• Comply with all applicable email marketing laws (e.g., CAN-SPAM, GDPR, or similar laws in your region).

3. Billing and Subscriptions

Subscriptions are billed monthly through Paystack. Usage limits depend on your plan tier and are clearly defined at signup.

You may cancel at any time; your plan remains active until the end of the current billing period.

Refund policy: If you cancel within 7 days of your initial subscription purchase, you may request a full refund. Renewals and partial months are not refundable.

4. Service Terms

We aim to provide reasonable service availability. Maintenance may be required occasionally, and we will give notice when possible.

Features may be updated or modified. Major changes will be announced with 30 days' notice.

We will not suspend or terminate your account without cause and reasonable notice, except where required for legal or security reasons.

5. Liability

LumoCade provides the Service on a best-effort basis. We are not responsible for indirect damages such as lost revenue, data loss, or business interruption.

However, we do not disclaim all liability. If an issue arises, both parties agree to act in good faith and reasonably to resolve disputes.

Any liability is limited to the amount paid by you in the previous 12 months.

6. Data and Privacy

Developers own their Subscriber data. LumoCade only processes this data to deliver the Service.

We provide tools to help manage data securely. Developers may export their data at any time.

Our Privacy Policy describes in detail how we handle account and subscriber information.

7. Termination

Either party may end the Service with reasonable notice.

Upon termination, Developers will have an opportunity to export their data for a defined period (typically 30 days).

Outstanding bills will be settled fairly, based on usage up to the termination date.

8. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.

9. Changes to These Terms

We may update these Terms occasionally. If significant changes are made, we will provide at least 30 days' notice.

Continued use of the Service after updates means you accept the revised Terms.

By using LumoCade, you confirm that you have read, understood, and agree to these Terms.
